On July 28, 2020, EPA filed an Expedited Consent Agreements and accompanying Final Order for violations of the Federal Insecticide, Fungicide and Rodenticide Act (FIFRA). Koch Farm Service failed to submit their Annual Pesticide Production report by the annual March 1st due date for their pesticide-production facility located in Tamaqua, Pennsylvania. When their report was submitted, Koch Farm Service reported zero-production. Koch Farm Service agreed to inactivate their establishment registration and, as a result, will not be assessed a monetary penalty. This also means that they can no longer produce pesticides at this location. EPA-registered pesticide-producing establishments are required to submit their production reports annually to the Agency, listing the names and types of pesticides they produce, the amounts produced and distributed in the previous year, and the amount they expect to produce in the coming year.
