EPA Region 10 issued a Consent Agreement and Final Order to CJ Air, LLC (Nez Perce, Idaho) for violations of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA). CJ Air, LLC is a Pesticide Aerial Applicator. In July and August 2018, an EPA credentialed inspector, investigated the improper disposal of used pesticide containers on the Nez Perce Reservation. The inspector found open, used, unrinsed containers of the pesticides Valent Asana XL (EPA Reg. No. 59639-209), Drexel Dimethoate LV-4 (EPA Reg. No. 19713-665), and BASF Priaxor Xenium (EPA Reg. No. 7969-311) in two dumpsters located on the Reservation. During the investigation, the improperly disposed pesticide containers were traced back to CJ Air, LLC. The improper disposal of a registered pesticide is a violation of Section 12(a)(2)(G) of FIFRA. Valent Asana XL s a restricted use product and is extremely toxic to fish and other aquatic organisms. CJ Air, LLC collected the improperly disposed pesticide containers upon discovery of the violation. CJ Air then washed, rinsed and recycled the containers. CJ Air, LLC also agreed to pay a civil penalty of $5,400.
