On September 7, 2023, the U.S. District Court for the Eastern State of Washington issued a Order approving the Consent Decree and dismissing the case for the matter involving Mr. Brock Maslonka (Defendant) to address CWA violations at the Defendant's property located near Cusick, WA. Defendant discharged dredged and/or fill material below the ordinary high-water mark of Perkins Slough without authorization under CWA Section 404. CWA violations resulted in the discharge of pollutants into waters of the United States. The Defendant has agreed to remove the unauthorized fill material, restore the native vegetation of the wetlands, and provide additional compensatory mitigation to revegetate and preserve adjacent riparian habitat. Defendants have also agreed to pay a penalty of $50,000.
