On August 6th, 2020, EPA issued this Amended Complaint and Notice of Opportunity for Hearing ( Amended Complaint ) to initiate a civil administrative penalty proceeding under Section 205(c)(I) of the Clean Air Act (CAA), 42 U.S.C. Section 7524(c)(I), and the Consolidated Rules of Practice Governing the Administrative Assessment of Civil Penalties and the Revocation/Termination or Suspension of Permits, ( Consolidated Rules ) at 40 C.F.R. Part 22. 40 C.F.R. Sections 22.13-14.
On February 22nd, 2021, the EPA amended the complaint.
As of June 28th, a consent agreement and final order was filed for a civil penalty.
