On August 28, 2020, a Consent Agreement and Final Order entered into by EPA and MarkWest Liberty Bluestone, L.L.C ( Respondent ) was filed with the Regional Hearing Clerk settling alleged violations of the Clean Air Act. The alleged violations were discovered as a result of a review of Respondent's compliance with a March 23, 2017 Administrative Compliance Order issued in connection with violations at Respondent's natural gas processing plant located at 774 Prospect Road in Evans City, Pennsylvania (Sarsen facility). The alleged violations include Respondent?' failures to timely conduct a third-party leak detection and repair audit, to timely comply with NSPS OOOO requirements for monitoring leaks at connectors, and to timely apply to incorporate applicable provisions of NSPS OOOO into a federally enforceable state operating permit as required by the March 23, 2017 Order. The failures have the potential for excess fugitive VOC emissions from the Sarsen facility. According to the Consent Agreement and Final Order, Respondent is assessed a penalty in the amount of one hundred and fifty thousand and twenty-five dollars ($150,025). PADEP was notified of this action and has raised no objection.
