On September 19, 2019, the Region filed an Expedited Settlement Agreement which settled EPA's penalty claim for violations of CWA Section 311(j) at the TA Operating, LLC located in Ashland, Virginia. The facility failed to have an adequate SPCC Plan, failed to conduct visual inspections on all bulk storage containers, failed to conduct adequate SPCC training, and failed to provide adequate secondary containment for mobile/portable containers. The respondent has agreed to pay a cash penalty of $1,844 to settle the matter.
