On September 18, 2020, the RJO ratified a Consent Agreement between EPA and Guttman Realty Company, the owner and operator of a fuels distribution facility in Belle Vernon, PA. The settlement requires the Respondent to pay a penalty of $47,209 to resolve alleged violation of CWA Section 311 and 40 CFR Part 112, which include failure to include required information in the SPCC plan facility diagram and to provide adequate secondary containment for some of the facility's bulk storage containers, mobile or portable containers, and one loading/unloading rack. The oil enforcement program is not delegated to the state. PADEP management was notified of this action.
