EPA alleges that Respondent violated the requirements of its National Pollutant Discharge Elimination System permit (Permit KSR113334), in violation of Section 402 of the Clean Water Act, 33 U.S.C. ? 1342. The EPA alleges that Respondent failed to: (1) ensure all stormwater controls are installed and effective; (2) properly document corrective actions; (3) install erosion controls or velocity dissipation devices along a stormwater conveyance channel; and (4) properly design or maintain the sites three sedimentation basins.
