Summary

On May 10, the importer attempted to import a shipment of Alcohol Wipes. CBP placed a hold on the shipment after it had been out-gated and picked up. Jaak Transport Inc. provided Loginet Inc.s photos of the Alcohol Wipes within the shipment to EPA. These showed that the label on the Alcohol Wipes had the following pesticidal claims: for use on toys, electronic products, office supplies, tableware, and childrens toys; statements such as Sterilization rate: 99.9%. Due to the its claims to sterilize surfaces, the Alcohol Wipes within this entry are pesticides. The distribution of an unregistered pesticide is an unlawful act under FIFRA Section 12(a)(1)(A), 7 U.S.C. Section 136j(a)(1)(A). The Alcohol Wipes had no EPA registration number, nor were they produced at an EPA establishment. These Alcohol Wipes are not registered with EPA and do not meet an exemption for lawful entry. Therefore, this product cannot be allowed entry into the United States.
