This civil administrative penalty assessment proceeding brought under Section 113(d) of the Clean Air Act, 42 U.S.C. Section 7413(d). Respondent agrees to the assessment of a penalty in the amount of $125,000 as final settlement of the civil claims against Respondent arising under the CAA.
