On September 18, 2020, Region 1 filed a consent agreement and final order (CAFO) resolving Toxic Substances Control Act (TSCA) violations at the Parsons Lane Associates, LLC (Parsons Lane) facility located in East Haven, Connecticut (Facility). The CAFO alleges that Parsons Lane violated TSCA PCB regulations governing the disposal of PCB liquids and the storage of PCB items. EPA learned of the TSCA violations when Eversource contacted the CT DEEP Emergency Response Unit to report a PCB release at the Facility that resulted from a transformer pole falling, and Parson Lane's subsequent improper storage of the transformers. Although the transformers were owned by Parsons Lane, Eversource remediated the PCB contaminated soil at the Facility. The company has agreed to pay a $38,682 penalty to resolve this matter and certifies that it is now operating in compliance with TSCA. The Region has coordinated with the State of Connecticut in this action. The State is not authorized to enforce the PCB regulations but supports the action.
