EPA Region 6 anticipates filing a Consent Agreement and Final Order by Friday, September 25, 2020, in the matter of The Pat Burke Company dba The Burke Company. The Burke Company was investigated on March 2, 2020 for potential violations with the Lead Based Paint Renovation Repair and Paint requirements of the Toxics Substances Control Act (TSCA). Seventeen (17) counts were identified including failure to maintain proper certification, failure to have a certified renovator assigned, failure to provide ?Renovate Right? brochure and failure to maintain records to demonstrate compliance with the work practice standards. EPA and the Respondent have agreed to settle the matter for $42,875 to be paid within 90 days of the effective date of the CAFO.
