On September 3, 2020, A.I.T Corporation attempted to import Sense Disinfectant Wipes. The broker provided photographs of this product. These showed that the label on the container bore the following pesticidal claims and directions for use: Kills 99.9% of Viruses & Bacteria , Kills Cold and Flu Viruses , Kills Staph, E.Coli, MRSA, Salmonella, Kleb , Use clean cut disinfecting wipes in homes, schools and institutions , Use to disinfect hard, non-porous surfaces . The label did not contain an EPA registration number or an EPA establishment number. The Sense Disinfectant Wipes disinfectant described above is an unregistered pesticide. The distribution of an unregistered pesticide is an unlawful act under FIFRA Section 12(a)(1)(A), 7 U.S.C. section 136j(a)(1)(A). Although broker provided a company number for BIOCHEM KOREA (96885), the label of the Sense Disinfectant Wipes did not bear an EPA establishment number. Therefore, the wipes are misbranded per Section 2(q)(1)(D) of FIFRA, 7 U.S.C. section 136(q)(1)(D). The distribution of a misbranded pesticide is an unlawful act under FIFRA Section 12(a)(1)(E), 7 U.S.C. section 136j(a)(1)(E).All pesticides are required to be registered with EPA before their entry into the United States(unless certain exemptions are met), and pesticides entering the United States cannot be misbranded. Therefore, this entry is denied pursuant to Section 17(c) of FIFRA 7 U.S.C. section 136o(c). Finally, the Notice of Arrival of Pesticides and Devices
