On December 15th, 2020, Region 10 filed a Consent Agreement and Final Order (CAFO) to address
violations of the Clean Water Act by KAG West LLC, located at 401 East Alexander Avenue, Tacoma, Washington. Respondent, which operates a trucking terminal, had numerous violations of the
CWA and its National Pollutant Discharge Elimination System (NPDES) permit. The violations
include, failure to install and/or maintain Best Management Practices (BMPs); failure to conduct sampling; failure to submit an annual report; failure to conduct annual training; failure to maintain a complete site map; and failure to implement secondary containment. Respondent agreed to pay a penalty of $133,225. The Environmental Benefits of this enforcement action will be a reduction of total suspended solids entering waters of the U.S. by 14,277 pounds per year.
