Summary

On February 12, 2021, EPA Region 10 filed a consent agreement and final order (CAFO) to address violations of the Clean Water Act (CWA) by South Bend Products LLC at their Washington Seafood Producers facility, located at 237 Robert Bush Drive, South Bend, WA 98586. Respondent, which operates a seafood processing facility had numerous violations of the CWA and its National Pollutant Discharge Elimination System (NPDES) permit. The violations include discharge of pollutants in excess of permit limits, failure to comply with discharge monitoring report (DMR) requirements, improper monitoring, and improper sample collection and preservation. Respondent agreed to pay a penalty of $101,630. The environmental benefits of this enforcement action will be an annual reduction in the discharge of the following pollutants into Washington?s waters: Total Residual Chlorine (TRC) - 94 lbs/year, Biochemical Oxygen Demand (BOD5) - 678 lbs total, Total Suspended Solids (TSS) - 10 lbs total, and Oil & Grease (O&G) - 262 lbs/year. These reductions will be achieved by improving effluent treatment, monitoring, and sampling procedures.
