On December 3, 2018, EPA identified that the Respondent operated facility located at 150 Saint Charles Street in Newark, New Jersey discharges stormwater associated with industrial activity to a Water of the United States without coverage under a permit or other authorization, in violation of Section 301(a) of the Act, 33 U.S.C. 1311. The Facility applied for coverage under a NJPDES permit in March 2019. The penalty has been calculated at $7,500.
