On May 10, 2019, EPA identified that the Respondent operated facility located at 540 Ulster Landing Road in Kingston, New York discharges stormwater associated with industrial activity to a Water of the United States without coverage under a permit or other authorization, in violation of Section 301(a) of the Act, 33 U.S.C. 1311. The Facility submitted a complete application to obtain coverage under a SPDES permit in October 2019. The penalty has been calculated at $7,500.
