On November 16, 2020, Region 10 filed a consent agreement and final order addressing violations of
the Clean Air Act and the Emergency Planning and Community Right-to-Know-Act Section 313
(Toxics Release Inventory) by Crowley Fuels LLC. The company violated the New Source
Performance Standards (NSPS Subpart XX and Kb) and National Emission Standards for Hazardous
Air Pollutants (NESHAP Subpart BBBBBB and CCCCCC) that apply to bulk gasoline distribution and
dispensing facilities. Specifically, the company violated CAA air regulations by not having air pollution
controls at its Juneau terminal to capture vapors released when tanker trucks are loaded with gasoline.
The company will install controls to reduce emissions from 3 large gasoline storage tanks and install
additional controls to reduce emissions from the loading of gasoline into gasoline delivery trucks. The
company also violated the NESHAP (Subpart CCCCCC) notification requirements for gasoline
distribution facilities in Juneau, Ketchikan, Douglas and Palmer. Additionally, the company violated
EPCRA Section 313 and failed to report the releases of several TRI-listed chemicals at its Juneau and
Ketchikan terminals, denying the public of access to this information.
