## Summary

On November 16, 2020, EPA Region 6 issued a Consent Agreement Final Order under its authority pursuant to Section 113(a)(1) of the Act, 42 U.S.C. 7413(d) to Raceland Raw Sugar, LLC - Raceland Factory (Raceland Raw Sugar) in response to violations of Raceland Raw Sugar's Title V Operating Permits and Louisianas federally approved State Implementation Plan (SIP): 

Title V Operating Permit No. 1560-00004-V10 requires that Raceland Raw Sugar limit its emissions of particulate matter of 10 microns or less (PM10) to 23.40 tons per year (tpy) and particulate matter of 2.5 microns or less (PM2.5) to 10.95 tpy at the Facility Boiler No. 2 (EQT 0003).  Based on EPAs review, EPA finds that Raceland Raw Sugar exceeded these permit limits for 2017. Specifically, Raceland Raw Sugar reported 30.92 tons of PM10 emissions and 14.47 tons of (PM2.5) emissions from the Boiler No. 2, which exceeded the permitted limits of 23.40 tons and 10.95 tons, respectively.  

Title V Operating Permit No. 1560-00004-V10, Specific Requirement 182, requires that Raceland Raw Sugar comply with the Part 70 General Conditions in L.A.C. 33:III.535.  General Condition R of LAC 33:III.535 requires a permittee to report permit deviations semiannually.  Based on EPA?s review, EPA finds that Raceland Raw Sugar failed to timely report the above-referenced PM10 and PM2.5 exceedances from the Boiler No. 2.
