Summary

On November 23, 2020, EPA entered into an administrative order on consent (Order) with Holtec Decommissioning International, LLC and Holtec Pilgrim, LLC (collectively Holtec) in which the companies agree to implement certain measures and meet interim limits while they finish decommissioning the Pilgrim Nuclear Power Plant in Plymouth, Massachusetts. On March 6, 2020, Holtec, filed with the EPA Environmental Appeals Board (EAB) a Petition for Review of the 2020 Permit (Petition). The Petitioners sought EAB review of, among other things, effluent limits and conditions related to Temperature and Total Residual Oxidants (TRO) and conditions related to the cooling water intake structure impacts to aquatic life impingement. The Order allows for a reasonable time frame and other flexibilities for achieving compliance with temperature, TRO, and cooling water intake concerns. This Order also resolves Holtec's EAB appeal of its NPDES permit.
