On November 13, 2020, EPA Region 5 and Tenneco Automotive Operating Company Inc. (Tenneco), of Marshall, Calhoun County, Michigan, entered into a Resource Conservation and Recovery Act (RCRA) Section 3008(a) Expedited Settlement Agreement and Final Order (ESAFO) resolving violations relating to failure to comply with the satellite accumulation area labeling and waste determination requirements. The ESAFO requires Tenneco, to pay a penalty of $8,000 and return to compliance with RCRA. The Tenneco, Marshall, Michigan facility generates hazardous waste chromium dust (D007) and other wastes from the manufacture and assembly of stainless-steel automotive exhaust systems. On April 14, 2020, EPA sent Tenneco a Notice of Violation (NOV) of alleged potential violations of RCRA based on the March 11, 2020 inspection. EPA identified the following potential violations: failure to label satellite accumulation area containers; failure to make a hazardous waste determination; failure to complete a Land Disposal Restriction form properly; failure to label a container with the words ?Used Oil?; and failure to keep a container of universal waste closed.
