On December 10, 2020 the Regional Judicial Officer signed a Final Order ratifying a Consent Agreement between EPA and Niermann Weeks Co., Inc., located at 760 Generals Highway, Millersville, Maryland. The Consent Agreement resolves alleged violations of RCRA C identified during a September 2018 compliance inspection.
The hazardous waste management regulations promulgated pursuant to RCRA Subtitle C provide for the management and transport of hazardous waste from the time and place of generation to its ultimate disposition at a RCRA treatment, storage or disposal facility. EPA routinely inspects hazardous waste generators for compliance with RCRA regulations in accordance with joint enforcement goals agreed upon by EPA and states authorized to implement RCRA C. The alleged RCRA C violations chiefly concern Niermann Weeks' management of hazardous waste container at its Facility. Niermann Weeks will pay a $10,000.00 penalty. The State of Maryland was notified of this action. The Consent Agreement and Final initiates and concluded this Enforcement action.
