On December 16, 2020 the Regional Judicial Officer signed a Final Order ratifying a Consent Agreement between EPA and Henkel-Harris, LLC. located at 2983 South Pleasant Valley Road, Winchester, Virginia 22601 (hereinafter the Facility ). The Consent Agreement resolves alleged violations of RCRA C identified during a September 2017 compliance inspection.
The hazardous waste management regulations promulgated pursuant to RCRA Subtitle C provide for the management and transport of hazardous waste from the time and place of generation to its ultimate disposition at a RCRA treatment, storage or disposal facility. EPA routinely inspects hazardous waste generators for compliance with RCRA regulations in accordance with joint enforcement goals agreed upon by EPA and states authorized to implement RCRA C. The alleged RCRA C violations chiefly concern Henkel-Harris management of hazardous waste container at its Facility. Henkel-Harris will pay a $1,000.00 penalty. The Commonwealth of Virginia was notified of this action. The Consent Agreement and Final initiates and concluded this enforcement action.
