Respondent was issued a NOW for the failure to submit EPA Form 3540-16 for CY 2019. NOW was signed on 12/31/20 and issued on 2/23/21 via certified mail.
On 3/23/21 EPA received a copy of EPA Form 3540-16 for CY 2019 and a copy of the signed certified mail receipt that demonstrates the form was received by EPA on 2/14/2020. The NOW issued on 2/23/21 is withdrawn and will not count as a FIFRA violation.
