Summary

On January 5, 2021, a Consent Agreement and Final Order entered into by EPA and Pypes Performance Exhaust, LLC ( Respondent ) was filed with the Regional Hearing Clerk settling alleged violations of the Clean Air Act. The alleged violations include Respondent's sales of illegal exhaust replacement pipes, known as defeat devices which mechanically bypass vehicle emission controls, such as a catalytic converters, diesel particulate filters, diesel oxidation catalysts, nitrogen adsorber catalysts or selective catalytic converter systems, installed in EPA-certified motor vehicles between January 1, 2016, and June 24, 2019. The Consent Agreement alleges that Respondent sold 18,324 of these defeat devices, and that at the time of the sales Respondent knew or should have known that the automotive components were being offered for sale or installed for such use or put to such use, constituting 18,324 violations of Section 203(a)(3)(B) of the CAA. The violations have the potential for excess emissions of CO, NOx and NMHC from the motor vehicles or motor vehicle engines on which the illegal components are installed. According to the Consent Agreement and Final Order, Respondent is assessed a penalty, based in part on a financial analyst's determination of its inability to pay a higher penalty, in the amount of eighty-four thousand dollars ($84,000). PADEP was notified of this action and has raised no objection.
