On October 10, 2019, an authorized representative of the EPA conducted an inspection of Respondent's facility, located in Austin, Texas to determine compliance with the Risk Management Program (RMP) regulations promulgated at 40 CFR Part 68 under Section 112(r) of the CAA, 42 USC 7412(r). The EPA found that Respondent had violated the RMP regulations as follows: 1) 40 CFR 68.39(b)-The owner or operator failed to document the rationale for the selection of the alternative release scenarios. 2) 40 CFR 68.50(c)-The owner or operator failed to document how the results of the hazard review were addressed. 3) 40 CFR 68.56(a)-The owner or operator failed to follow required timelines for preventative maintenance due to software issues.
