On August 24, 2020, EPA informed QMF of an alleged potential violation of RCRA. Specifically, EPA informed QMF that based on a review of data, it appeared that QMF had generated hazardous waste in quantities that qualified QMF for large quantity generator status during 2015, 2017, and 2018. Thus, EPA identified the following potential violation: failure to properly file annual reports in violation of 35 Ill. Adm. Code 722.141 [40 C.F.R. ? 262.41]. EPA offered and QMF agreed to resolve the violation through a streamlined CAFO settlement process.
EPA Region 5 identified the violation through its RCRA Data Mining Initiative, which uses Agency data sources to identify high-probability violators and offer them a streamlined opportunity to work with EPA to further identify and resolve the violation. The Illinois Environmental Protection Agency (Illinois EPA) was copied on the August 24, 2020 letter that EPA sent to QMF. Illinois EPA will assist by processing QMF?s updated annual reports and annual reporting fees. QMF has agreed to come into compliance with the relevant provisions of RCRA within 30 days after the effective date of the CAFO.
