On February 16, 2021, Region 3 filed a Final Order and Consent Agreement resolving EPA's allegations that Aphena Pharma Solutions Maryland, LLC, located at 7978 Industrial Park Road, Easton, Maryland, (Aphena) violated specific RCRA hazardous waste management regulations promulgated by Maryland, authorized by EPA and set forth in the Code of Maryland Regulations (COMAR). Aphena is a pharmaceutical, consumer health and medical device packaging and manufacturing company The Consent Agreement alleges that Aphena: a) accumulated hazardous waste at the Facility for greater than 90-days and failed to meet the 90-day limitation for accumulating hazardous waste on-site without a permit as set forth at COMAR 26.13.03.05.E, b) failed to comply with the hazardous waste container management requirement set forth at COMAR 26.13.05.09.D, c) failed to comply with the annual review of initial training requirement set forth at COMAR 26.13.05.02.G(3) and d) failed to meet the Contingency Plan requirements set forth at COMAR 26.13.05.04.C(4) and (5). Aphena has agreed to pay a $82,120 civil penalty in accordance with the terms of the Consent Agreement. The Pennsylvania Department of Environmental Protection was informed of this enforcement matter.
