Summary

]: On February 25, 2021, Region 3 filed a Consent Agreement and Final Order against Fil-Tec, Inc. of Smithsburg, Maryland for improper hazardous waste management methods at its facility. In this administrative settlement, Fil-Tec, Inc. has agreed to pay a $85,680 penalty and has certified that it has come into compliance with regard to the RCRA Subtitle C violations alleged in the Consent Agreement and Final Order. Fil-Tec, Inc. manufactures specialty yarns and threads for products used primarily in the defense industry. In the Consent Agreement, EPA alleges that Fil-Tec, Inc. engaged in the storage of hazardous waste without a permit. Fil-Tec, Inc. also failed to properly mark containers of hazardous waste with accumulation start dates and with words that would identify the containers as hazardous waste. In addition, Fil-Tec, Inc. was missing required weekly inspection records for a hazardous waste storage area, failed to keep a hazardous waste container closed, failed to make a waste determination and failed to provide annual hazardous waste management training to its employees, among other allegations. The Maryland Department of the Environment was given prior notice of this enforcement matter as of July 14, 2020.
