On April 19, 2021, Region 10 and Mr. Kirk Wilson (Respondent), in Tolsona Lake, near Glennallen,
Alaska entered into an Administrative Order on Consent. EPA alleges that Respondent discharged
dredged and/or fill material into waters of the United States, including wetlands that share a surface
hydrological connection to Tolsona Lake, a traditional navigable water, without a permit or
authorization from the U.S. Army Corps of Engineers (Corps). As required in the AOC, a Final
Mitigation Work Plan was submitted and EPA approved. The EPA-approved Final Mitigation Work
Plan included backfilling of a ditch constructed along the east side of the red road, and installing certain
culverts and additional ditches at the Site. These actions will improve the surface hydrological
functions and connections between the wetlands and Tolsona Lake that are currently impeded by the
unauthorized Red Road. Completion of the work would mitigate approximately 1 acre of aquatic
resources at a cost of approximately $8,000. The ADNR and the Corps have issued authorizations to
implement the EPA-approved Final Mitigation Work Plan on Site and State of Alaska property, and in
compliance with the Clean Water Act Section 404. The Joint Modification to the AOC would include
additional Exhibits: B. EPA-approved Final Mitigation Work Plan; C. ADNR Letter of Authorization;
and D. Corps NWP 32; and strike out/replace certain requirements, which have been completed since
the AOC was fully executed
