20210319 - CONSENT AGREEMENT AND FINAL ORDER ISSUED, ASSESSING PENALTY OF $1,492 DUE WITHIN 30 DAYS.
ALLEGED VIOLATIONS:
At some time during calendar year 2017, ammonia was present at the Facility in an amount equal
to or greater than 500 pounds.
Respondent failed to submit a completed Emergency and Hazardous Chemical Inventory Form
for ammonia to the SERC, LEPC, and fire department with jurisdiction over the Facility for
calendar year 2017 by March 1 of the following calendar year.
Respondent submitted a calendar year 2017 Emergency and Hazardous Chemical Inventory
Form on August 9, 2018. Respondent identified the Facility?s failure to timely submit a
calendar year 2017 Emergency and Hazardous Chemical Inventory Form while performing a
self-audit. Calendar year 2018, 2019 and 2020 Emergency and Hazardous Chemical
Inventory Forms were submitted before March 1 of the following calendar year.
Respondent violated the reporting requirements of Section 312 of EPCRA by failing to submit
the required Emergency and Hazardous Chemical Inventory Form for ammonia for calendar year
2017 by March 1, 2018 and is therefore subject to the assessment of penalties under Section 325
of EPCRA, 42 U.S.C. ? 11045.
