On March 16, 2021, EPA Region 1 filed a CAFO against Phoenix Products Company ( Phoenix ) resolving FIFRA claims for alleged violations of the Federal Insecticide, Fungicide and Rodenticide Act (FIFRA) and FIFRA regulations at its pesticide producing establishments in Terryville, Connecticut. The CAFO requires Phoenix to pay a monetary penalty of $33,080 for these violations. Phoenix produces pesticides as a primary registrant, a supplemental registrant, and as a contract production facility. EPA alleges Phoenix distributed or sold misbranded pesticides (mainly pool chemicals) on multiple occasions during 2018 and 2019. The violations involve nine separate Phoenix pesticide products.
