On March 29, 2021, EPA Region 2 issued a Consent Agreement and Final Order (CA/FO) that simultaneously commenced and concluded an administrative enforcement case against the Respondent, which, before it relocated its business operations, had owned and operated a facility in New Windsor, New York. The Respondent is engaged in manufacturing and printing on polyethylene bags. During its operations, it violated RCRA and the New York State authorized hazardous waste regulations by failing to comply with conditions that would have allowed it to store hazardous waste without having interim status or a permit and by failing to minimize the possibility of fire, explosion, or release of hazardous waste or constituents at this facility. Under the settlement, Respondent will pay a total penalty of $30,121.66 in three installments within three months of the effective date of the Final Order. The company is also required to comply with the RCRA rules it had violated at its new facility in Newburgh, New York.
