On April1, 2021 the Regional Judicial Officer signed a Final Order ratifying a Consent Agreement between EPA and FedChem L.L.C., a chemical company located in Bethlehem, Pennsylvania. The Consent Agreement resolves alleged violations of RCRA C identified during a May 2019 EPA inspection of Fedchem's Bethlehem, Pennsylvania facility in which an inspector from the Pennsylvania Department of Environmental Protection also participated..
The hazardous waste management regulations promulgated pursuant to RCRA Subtitle C provide for the management and transport of hazardous waste from the time and place of generation to its ultimate disposition at a RCRA treatment, storage or disposal facility. EPA routinely inspects hazardous waste generators for compliance with RCRA regulations in accordance with joint enforcement goals agreed upon by EPA and states authorized to implement RCRA C. The alleged RCRA C violations at FedChem?s Bethlehem Facility chiefly concerned the storage of hazardous waste in three tanks. Up to the date of the EPA Inspection, Fedchem had not managed these tanks in accordance RCRA C regulations. The tanks have since been removed from service.
