On December 17, 2020, Region 1 and Fairchild Semiconductor Corporation (Fairchild) settled a Resource Conservation and Recovery Act (RCRA) administrative penalty case for alleged violations of RCRA air emissions regulations at Fairchild's semiconductor manufacturing facility in South Portland, Maine. The RCRA air regulations (Subpart BB and CC) are undelegated in Maine and enforceable only by EPA. Under the settlement, Fairchild certified that the facility corrected its RCRA violations and instituted a Subpart BB/CC compliance program that will help reduce hazardous air pollutants and volatile organic compounds (VOCs) emissions at the facility. Fairchild also agreed to pay a $104,545 settlement penalty.
