On April 13, 2021, EPA Region III filed a signed CAFO resolving alleged violations of the CWA by Clark Construction Group, LLC. EPA alleged that the respondent violated the applicable construction stormwater permit at the Square 696 site located in Washington, DC. The alleged violations consisted of failing to post notice of permit coverage, to keep the SWPPP updated, to complete corrective action reports and to properly maintain and/or install best management practices required by the facility?s SWPPP and the CWA permit. EPA notified DC DOEE of its action. The Respondent will pay $26,000 in civil penalties under the CAFO.
