On April 8, 2021, Region 1 filed a Consent Agreement and Final Order (CAFO) to resolve alleged violations of Emergency Planning and Community Right-to-Know Act (EPCRA) Section 113 by Nichols Portland, LLC at its Portland, Maine facility. Under the CAFO, Nichols Portland will pay a penalty of $36,943 to settle EPA's claims. The alleged violations involved late reporting of Toxic Release Inventory forms in 2018 for copper and nickel used at the metal parts manufacturing facility. Enforcement of EPCRA's reporting requirements ensures that communities are not deprived of their right to know about chemical releases that may affect public health and the environment.
