On July 15, 2021, EPA Region 10 has issued an Consent Agreement and Final Order ( CAFO ) to
Granite Excavation Inc., Nisula Gravel Pit (?Respondent?) for Clean Water Act (?CWA?) violations in
McCall, Idaho, resulting from the discharge of unauthorized, non-stormwater dewatering water from an
active excavation pit, SWPPP violations, failure to select, design, and implement adequate control
measures, failure to conduct inspections, and failure to timely and accurately report monitoring. The
Respondent has agreed to enter into a Administrative Compliance Order on Consent to take specific
compliance measures to comes into and remain in compliance with its current NPDES permit coverage,
any coverage under a new or reissued NPDES permit, and the Clean Water Act. The cost of the
compliance action is approximately $5,415. Respondent has also agreed to pay $64,800 in penalties to
resolve the CWA violations.
