On May 3, 2021, EPA Region 6 issued an Expedited Settlement Agreement and Final Order (ESAFO) under its authority pursuant to the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) to Performance Chemical Company of Midland, TX. The ESAFO was issued in response to an alleged violation of Section 7(c) of FIFRA, 7 U.S.C. Section 136e(c), for failing to timely submit an annual pesticide production report on or before March 1, 2020. Performance Chemical Company has corrected the alleged violation and has paid a civil penalty of $500.
