On July 22, 2021, Region 10 filed a Consent Agreement and Final Order (CAFO) to address violations of the Clean Water Act by the City of Wapato's facility, located at 68170 U.S. Highway 97 Wapato, Washington 98951. The City operates a wastewater treatment facility that violated the CWA and its National Pollutant Discharge Elimination System (NPDES) permit. The violations include, over 3,000 effluent exceedance violations; failure to keep the facility's Quality Assurance Plan (QAP) up to date; and failure to submit complete and timely Discharge Monitoring Reports (DMRs). Respondent agreed to pay a penalty of $25,750. The Environmental Benefits of this
enforcement action will be a 19 pound per year reduction in total recoverable copper, and a 109 pound per year reduction of total recoverable zinc entering waters of the U.S.
