This letter acknowledges receipt of the arsenic, combined radium 226 and radium 228, and gross alpha particles compliance plan and construction schedule submitted by the Respondent, in response to Administrative Order, Docket Number SDWA-06-2019-1235, issued to you on July 3, 2019. EPA has determined that the plan, which specifies a timeline for bringing the Tempe Water Supply Corporation 1 into compliance with the maximum contaminant level for arsenic, combined radium 226 and radium 228, and gross alpha and the construction schedule, satisfies Section C of the Order 1235. The EPA?s acceptance of the plan does not guarantee compliance with the Safe Drinking Water Act (SDWA); Tempe Water Supply Corporation 1 remains solely responsible for compliance with the SDWA.
