On June 7, 2021 Region III filed a CAFO simultaneously initiating and resolving a civil penalty action against East Coast Diesel, LLC ( Respondent ), which at all times relevant to the CAFO owned and operated a facility which sold, and offered for sale, aftermarket parts and components intended for use with, or as part of, motor vehicles or motor vehicle engines, located at 529 Shirksville Road, Jonestown, PA 17038 (the Facility ). The basis of the CAFO is Respondent's violation of Section 203(a)(3) of the CAA, 42 U.S.C. 7522(a)(3), by having sold, and offered for sale, aftermarket parts and components intended for use with, or as part of, motor vehicles or motor vehicle engines that have a principal effect of bypassing, defeating, or rendering inoperative emission control devices and elements of design installed in or on a motor vehicle or motor vehicle engine on 632 instances between January 1, 2016 and October 16, 2018. The failure to meet these requirements was identified by a CAA Section 114 information request dated October 16, 2018, and Respondent's response thereto, dated February 13, 2019.
