On May 28, 2021, EPA Region III filed a signed Consent Agreement and Final Order ( CAFO ) resolving an action against Dutton's Mill Associates, L.P., dba IceWorks Skating Complex ( IceWorks ) for an alleged violation of Section 103 of CERCLA, and Section 304 and 312 of EPCRA, in connection with a facility located in Aston, PA. EPA alleges that IceWorks failed to immediately notify the National Response Center and the State Emergency Planning Commission (SERC) of an anhydrous ammonia release from its facility on August 2, 2018 located in Aston, Pennsylvania. EPA also alleges that IceWorks failed to submit accurate/complete Tier II forms for 2016 and 2017 to the SERC, LEPC and the Local Fire Department. The agreement requires Respondent to pay $30,148.00 in civil penalties. The Commonwealth of Pennsylvania was advised of this enforcement action and did not raise any objections. CERCLA 103, EPCRA 304, and EPCRA 312 release reporting and chemical identification helps communities plan for chemical emergencies by requiring industry to report on the storage, use, and releases of hazardous substances to federal, state, and local governments allowing them to use this information to prepare their community from potential risks.
