On April 23, 2021, Region 1 filed a combined complaint, consent agreement and final order that simultaneously commenced and settled EPA�s enforcement action against Praetorian Disaster Response, LLC dba SERVPRO of Bennington and Rutland Counties (Praetorian) for violating the TSCA Renovation, Repair and Painting Rule (RRP Rule) at three residential properties located in Vermont. Praetorian violated the RRP Rule by failing to establish and maintain records relating to reportedly emergency renovations at pre-1978 housing. Certain provisions of the RRP Rule do not apply to events that, if not immediately attended to, present a safety or public health hazard or threaten equipment and/or property with significant damage. However, after addressing true emergency situations, firms are NOT exempt from the RRP Rule�s requirements related to cleaning, cleaning verification, and recordkeeping. The settlement calls for Praetorian to comply with the RRP Rule and pay a $3,998 penalty. The State of Vermont Department of Public Health is aware of EPA�s enforcement action and is supportive of it. This settlement will help to prevent children from being exposed to lead-based paint.
