Expedited Settlement Agreement (ESA).
EPA Region 10 Settles with AD800, LLC & Brownstone Construction Management (Eagle, ID) for
CWA Violations. On September 27, 2021, Region 10 filed a consent agreement and final order
resolving violations of the Clean Water Act by AD800, LLC & Brownstone Construction Management
for their Avebury Subdivision construction site in Meridian, Idaho. AD800, LLC & Brownstone
Construction Management failed to obtain coverage under EPA's NPDES Construction General Permit
(CGP), provide timely stabilization, and provide reports showing self-inspections. Correcting these
violations prevented an estimated 893 pounds of sediment from reaching sediment impaired Five Mile
Creek. This area drains to the Lower Boise River watershed. This River system is listed as impaired for
sedimentation/siltation, temperature, Chlorpyrifos and Malathion. The Respondents have agreed to pay
a penalty of $8,160 and return to compliance. The estimated cost of injunctive relief is $1,500.
