Earth Science Labs, Inc. is in violation of FIFRA section 12(a)(1)(E) for selling or distributing a pesticide that is misbranded if a claim made for it as a part of its distribution or sale substantially differs from any claims made for it as a part of the statement required in connection with its registration under section 3 of FIFRA, FIFRA ? 12(a)(1)(B), 7 U.S.C. ? 136j(a)(1)(B).
