6/21/2021 - CONSENT AGREEMENT AND FINAL ORDER ISSUED ASSESSING A PENALTY OF $5,700.00. PENALTY TO PAID IN TWO EQUAL INSTALLMENTS WITHIN THE EFFECTIVE DATE OF THE CAFO: THE FIRST PAYMENT DUE WITHIN 90 DAYS ; THE SECOND PAYMENT DUE WITHIN 180 DAYS.
ALLEGED VIOLATIONS:
BASED ON THE EPA?S REVIEW OF THE RESPONDENT?S RECORDS, THE EPA HAS DETERMINED THAT PRIOR TO OFFERING AND ENTERING INTO EACH CONTRACT FOR LEASE OF TARGET HOUSING, THE RESPONDENT FAILED TO:
A. INCLUDE AS AN ATTACHMENT OR WITHIN THE CONTRACT TO LEASE TARGET HOUSING A STATEMENT BY THE LESSEE AFFIRMING RECEIPT OF THE INFORMATION REQUIRED UNDER 40 C.F.R. ? 745.113(B)(2) AND 40 C.F.R. ? 745.113(B)(3), AND THE LEAD HAZARD PAMPHLET REQUIRED UNDER 15 U.S.C. 2686 IN VIOLATION OF 40 C.F.R. ? 745.113(B)(4);
B. INCLUDE AS AN ATTACHMENT OR WITHIN THE CONTRACT TO LEASE TARGET HOUSING A STATEMENT BY THE AGENTS INVOLVED IN THE TRANSACTION TO LEASE TARGET HOUSING THAT THE AGENTS HAVE INFORMED THE LESSOR OF THE LESSOR?S OBLIGATIONS, AND THAT THE AGENTS ARE AWARE OF THEIR DUTY TO ENSURE COMPLIANCE IN VIOLATION OF 40 C.F.R. ? 745.113(B)(5), AS PROMULGATED AT 61 FEDERAL REGISTER 9085 (MARCH 6, 1996); AND
C. INCLUDE AS AN ATTACHMENT OR WITHIN THE CONTRACT TO LEASE TARGET HOUSING, THE SIGNATURES OF THE LESSORS, AGENTS, AND LESSEES, CERTIFYING TO THE ACCURACY OF THEIR STATEMENTS, TO THE BEST OF THEIR KNOWLEDGE, ALONG WITH THE DATES OF SIGNATURE IN VIOLATION OF 40 C.F.R. ? 745.113(B)(6).
