On June 9, 2021, EPA-Region III signed a Consent Agreement and Final Order with PM Properties, Inc., c/o CrossAmerica Partners LP, retailers of gasoline, diesel and kerosene. The company is based in Allentown, Pennsylvania, and the retail facility at issue is located in Verona, Virginia. The company was cited for failure to conduct tank release detection, failure to conduct annual functionality testing of the Line Leak Detector system, failure to conduct piping release detection, and failure to have functioning spill prevention equipment for its Underground Storage Tank (UST) systems at its Verona, Virginia facility. The agreement, which contains both a Consent Agreement and Compliance Order, initiated and resolved the matter. Failure to perform the required RCRA Subtitle I testing and monitoring of petroleum UST systems can lead to groundwater and soil contamination with petroleum products, which can cause exposure and harm to both human health and the environment. The Compliance Order requires PM Properties, Inc, c/o CrossAmerica Partners LP to pay a $25,603 penalty.
