A CA/FO with Respondent was signed by the Acting RA on June 17, 2021. The facility of about four acres in the Ironbound section of Newark, NJ, manufactures defoamers, anti-fungal agents and bactericides for the paint and coating industry. The facility, an LQG in at least some months, is also a portion of the Pierson's Creek Superfund site as a result of releases from previous owner/operators. Based on a July 2019 inspection led by EPA contractors and subsequent 3007 information request, the facility was found to have failed to make hazardous waste determinations for some wastes, had not made required arrangements with a local hospital, did not have spill response equipment at the storage area, and had container management issues with some drums, including a few rusted or bulging drums, missing labels, and incomplete labels. Through a pre-filing exchange process, the Respondent promptly corrected the violations identified by EPA, changed internal practices to prevent reoccurrence of such violations, and agreed to pay a $44,500 penalty.
