On September 29, 2021, Region 10 filed an industrial non-filer expedited settlement agreement
resolving violations of the Clean Water Act (CWA) by Vintage Airframes, LLC for their operation at
the City of Caldwell's Industrial Airport (Airport) in Caldwell, Idaho. EPA identified Respondent to be
an operator at the Airport that conducted industrial activities for airports requiring coverage under
EPA's Stormwater Multi Sector General Permit (MSGP). EPA's determination followed an October 28,
2019 inspection by Idaho Department of Environmental Quality (IDEQ), an EPA administrative
compliance order with the City of Caldwell, and the response to an EPA information request sent to the
Respondent. EPA determined that Respondent violated the CWA at the Airport by not obtaining
coverage under EPA?s MSGP. Discharges from the Airport travels through the following water
bodies: East Caldwell Drain, Indian Creek, Boise River, Snake River, Columbia River, Pacific Ocean.
Significant portions of the discharge path is through anadromous fish passage waters.
To return to compliance, the Respondent has paid a $2,500 penalty, developed and implemented a
Stormwater Pollution Prevention Plan with the City of Caldwell, and obtained coverage under IDEQ's
applicable industrial stormwater permit. The estimated cost of implementing this injunctive relief is
